Personal Information Collection Statement

HK JEBN Limited and its group companies in Hong Kong and Macau (“HK JEBN”, “us” or “our”) respect your privacy and comply with the provisions of the Personal Data (Privacy) Ordinance (Chapter 486) of the Laws of the Hong Kong Special Administrative Region and the Personal Data Protection Act of the Macao Special Administrative Region (as applicable) in collecting, transmitting, storing and using your personal data.
 
This privacy policy (the “Policy”) explains our practices regarding your privacy, and is incorporated into and forms an integral part of our HK JEBN Membership Terms and Conditions (https://www.hkjebn.com/tw/hk/other/view/terms-and-conditions) and our Terms and Conditions of sale (including the terms and conditions for our delivery services and shopping protection).
 
Personal data means any personally identifying information or data (such as name, address, email address and phone number), from which it is practicable for the identity of the individual to be ascertained.
 
We are the processor of your personal data. By providing personal data to us, you are deemed to have agreed to this Policy as may be updated from time to time. We may not send you individual notices so you are advised to check our website regularly for the updates.
 
 
1.     Collection of Personal Data
1.1   We may collect your personal data when you submit a membership application, request for services (e.g. delivery or product authentication) or contact us.
 
1.2   If you are under the age of eighteen (18), you must obtain consent of your parent or guardian before providing us with any personal data.
 
1.3   Where personal data are submitted by you on behalf of another individual, you represent and warrant to us that all the necessary consents have been obtained from the relevant individual.
 
1.4   HK JEBN will use the personal data provided to us for the below purposes and for uses relating directly thereto. Such purposes are divided into obligatory purposes and voluntary purposes. If personal data is to be used for an obligatory purpose, fields will be marked as “mandatory” in our Members Application Form, and in other situations (such as when handling your enquiries and requests), we will advise that such personal data is mandatory. If personal data is only to be used for a voluntary purpose, it is up to you to decide if you want to provide us with such information.
 
1.5   Purposes for which it is obligatory for you to provide your personal data are:-
(a)      processing your membership application;
(b)     enabling you to enjoy and continue to enjoy the members’ privileges;
(c)      renewal and termination your membership;
(d)     management of your membership and personal data;
(e)      provision of our products and services and completion the transaction(s) requested by you;
(f)      handling and following up on our your enquiries and complaints;
(g)     verification of your identity;
(h)     notifying you of any changes to our membership programme; and
(i)       making disclosure to any governmental, regulatory and law enforcement authority in Hong Kong and overseas jurisdictions for complying with the requirements of any law or regulation binding on us.
 
1.6   Purposes for which it is only voluntary for you to provide your personal data are:-
(a)      enabling us to provide products and services better tailored to your needs;
(b)     monitoring and analyzing trends and usage in connection with our products and services;
(c)      enabling us to better understand the demographics of our customers;
(d)     conducting research in connection with our products and services;
(e)      conducting statistical analysis of your behaviours and interests in relation to our products and services;
(f)      conducting consumer data analysis;
(g)     making recommendations to you and other customers about products and services in which you or other customers may be interested; and
(h)     any other purposes as may be agreed by you from time to time.
 
1.7   If we have received your consent (which includes your indication of no objection), we may use your name, email address, phone number, region of residence, gender, age group and/or your shopping record etc. to market our products and services, those of any member of HK JEBN group and updates, rewards, promotions and other activities of HK JEBN group. If you no longer wish us to use your personal data for direct marketing, please email us at [email protected] anytime. We shall update our archive within fourteen (14) days after we receive your notification.
 
2.     Disclosure of Personal Data
While we will take all practicable and reasonable steps to protect your personal data from unauthorized or accidental access, disclosure, misuse or processing, or from alteration, destruction or loss, we may transfer/assign such data to the following parties:-
(a)   any relevant actual or proposed assignee, transferee or successor of or to our rights in respect of your personal data, if we decide to sell any part of our business;
(b)  any agents, suppliers, contractors, professional advisors, insurers, other network operators or third party service providers who provide administrative, computer and other services to us or in connection with our products or services;
(c)   any person to whom we are obliged to make disclosure under the requirement of any law or regulation binding on us or request of any governmental, regulatory or law enforcement authorities; and/or
(d)  governmental authorities or other third parties assisting us detecting, investigating, preventing or otherwise addressing fraud, security or technical issues.
 
3.     Cookies
Cookies are pieces of information that are automatically stored on your device when you visit certain parts of our website, and we may use cookies to provide you with certain services and enhance your experience. A cookie can be used to identify a device but is not used to collect personal information of individual users of our website. Most web browsers accept cookies automatically, and you can edit your browser options to block the same. However, if you do so, you may not be able to use certain functions of our website. By accessing such parts of our website, you consent to the use of these cookies.
 
4.     Security of Personal Data
4.1   Save as provided in Sections 2(a) to (e) above, your personal data will be accessed only by our employees or contractors who are authorized to do so. Employees and contractors designated to handle personal data will be instructed to do so only in accordance with this Policy.
 
4.2   We have implemented reasonable security measures to safeguard your personal data from unauthorized access, disclosure, use and modification, but cannot guarantee that the handling of your personal data will be completely secure.
 
5.     Retention of Personal Data
We will retain your personal data for as long as necessary to fulfill the purposes for which such data was collected. We will then destroy such data unless the retention thereof is required to meet legal, regulatory or accounting requirements or to protect our interests under any applicable laws or regulations.
 
6.     Your Rights
6.1   You have, inter alia, the following rights:-
(a)   to check whether we hold data about you, access to and obtain copies of such data;
(b)  to require us to correct and supplement any data relating to you which are inaccurate or incomplete;
(c)   to ascertain our policies and practices in relation to personal data and to be informed of the kind(s) of your personal data held by us;
(d)  to request that we do not use your personal data for direct marketing; and
(e)   to withdraw your consent for our collection and processing of your personal data (however, this will not affect the lawfulness of any processing carried out before you withdraw your consent; if you withdraw your consent, we may be unable to provide certain products or services to you).
 
6.2   While we will accommodate your requests as far as possible, we may be unable to accommodate all your requests due to specific legal reasons (which we will inform you of, if applicable). All requests will be considered within forty (40) days of receipt. It may take us more than forty (40) days to attend to your request if your request is particularly complex or if you have made multiple requests. We will notify you if this is the case.
 
6.3   To exercise any of your foregoing rights, please email us at [email protected], marking your communication “Confidential” and specifying relevant information (such as your name and membership number), so we may attend to your request promptly. We may in our response ask you to provide certain details about yourself so that we can be sure you are the person to whom the relevant personal data refers. We may charge you a reasonable fee for processing such requests.
 
7.     General
7.1   If any part of this Policy shall be deemed unlawful or for any reason unenforceable, then that provision shall be deemed to be severable from this Policy and shall not affect the validity and enforceability of any of the remaining provision of this Policy.
 
7.2   If there is any inconsistency or conflict between the English and Chinese version of this Policy, the Chinese version shall prevail.
